ARTICLE 1:
SCOPE These General Terms and Conditions of Sale (GTCs) apply to all orders placed on the website for the sale of fashion accessories, both within France and internationally. They apply to all sales concluded with either professional clients or individual consumers.
ARTICLE 2:
PRICES Prices are listed in euros (EUR), including VAT for deliveries within the European Union. Outside the EU, customs duties and local taxes may apply and will be the sole responsibility of the customer. Shipping costs are displayed before finalizing the order. Placing an order confirms full acceptance of these conditions.
ARTICLE 3:
ORDERS An order is deemed validated once full payment has been received, thereby confirming acceptance of the GTCs. A confirmation email will be sent to the buyer within 24 hours. Online validation constitutes an electronic signature and expresses explicit consent to the sale and the present conditions.
ARTICLE 4:
PAYMENT Accepted payment methods for immediate payment include: Bank cards (secured via SSL and Stripe), PayPal, and bank transfer via a secure SSL platform.
ARTICLE 5:
DELIVERY Orders are delivered within 30 days maximum for metropolitan France via Colissimo or Chronopost. For deliveries outside of metropolitan France, timelines may vary, with a maximum of 60 days. Free shipping is offered for orders over EUR75.00.
ARTICLE 6:
RIGHT OF WITHDRAWAL You have 14 days from receipt of your order to exercise your right of withdrawal. Returned items must be new, unworn, unopened, unused, in their original packaging, and with all tags intact. Return shipping costs are at the buyer's expense (unless the product is proven to be defective). Refunds will be issued within 14 days, via the original payment method or another agreed-upon method. A withdrawal form is attached to these terms.
ARTICLE 7:
WARRANTIES All products are covered by the legal guarantee of conformity for 2 years (Article L.217-4 of the French Consumer Code) and the guarantee against hidden defects for 2 years from the discovery of the defect (Article 1641 of the French Civil Code).
ARTICLE 8:
LIABILITY KR French Créateur shall not be held liable for any indirect, immaterial, or consequential damages resulting from the purchase of products.
ARTICLE 9:
PERSONAL DATA Data collection is strictly necessary for order processing and customer outreach, subject to prior consent. Clients have the right to access, rectify, and delete their data in accordance with the GDPR. Clients are encouraged to review our detailed Privacy Policy at the following link: [Insert Link].
ARTICLE 10:
DISPUTES Before taking legal action, the client should seek an amicable solution. In case of difficulty, they may contact a mediator or use the EU Online Dispute Resolution platform: https://ec.europa.eu/odr. Competent court: Commercial Court of Toulon (France).
ARTICLE 11:
APPLICABLE LAW French law applies, except where mandatory provisions of the consumer's country of residence (outside the EU) prevail.
